On March 26, 2025, the third traning seminar of IMOLA IV Project took place in an online format, bringing together the IMOLA IV members, including legal professionals and land registry representatives across Europe, as well as the Project Manager, Mr. Pedro Pernas, and the Technical Director of the project, Mrs. Anabel Fraga.

This seminar focused on the Harmonization of Private Law in Europe with three key areas:

  1. The presentation of the results of the Mortgage questionnaire in the Knowledge Manager
  2. The use of the Privative Comparative Law
  3. Exposition of the new General Questions. Improvement of the Land Registry Publicity I Factsheet

Opening and Project Overview

Mr. Mihai Taus, ELRA President, welcomed the 39 participants of 15 member associations that assisted the meeting, highliting the importance of the IMOLA IV Project in consolidating land registries and enhancing cross-border cooperation. He also mentioned the critical role of the project in the current economic, social and political context, stressing the need for mutual trust and efficient collaboration.

Mortgage Questionnaire Results

Mrs. Elena Prada, ELRA Treasurer & CP of Libro Fondiario e Catasto di Trento, the results of the mortgage questionnaire answered by IMOLA IV members. She highlighted the importance of the four months methodology and the legislative, case law, judicial, doctrinal, and Land Registry formats. She spotlighted the collateral nature of mortgages in most systems, except for Estonia and Sweden, and discussed the correlation between mortgage and money debt, with most contact points indicating that a mortgage can guarantee different obligations. Preliminary results showed interesting findings, such as the constitutive principle, the ability of a mortgage to guarantee the debt of a third party and money debt.

Harmonization of Mortgage Law in Europe

Mrs. Francesca Fiorentini, Professor of Private Comparative Law at Trieste Faculty of Law discussed the harmonization of mortgage law in Europe, focusing on the differences between various legal systems and the importance of understanding these differences for mutual understanding. She emphasized the need for appropriate legal language and homologation of legal categories to facilitate communication between jurisdictions.

Conclusion

The seminar concluded with the intervention of Mr. Pedro Pernas and Mrs. Anabel Fraga who introduced updates in the Knowledge Manager and next steps to implement in the platform, together with IMOLA IV members.
