Notice of a proceeding which may involve the confiscation

Home / European Land Registry Network / Scotland / Notice of a proceeding which may involve the confiscation

1. Does your national system admit such restriction?

This land register system  does not envisage this kind of notice nor includes the possibility of registering a notice as such.

2. In your system, once registered this restriction, does it block or freeze subsequent registrations (mostly the ones promoted by the owner of the property) until being removed?

N/A

3. In your system, in principle, will the registration of this restriction be temporary (under a deadline) or indefinitely (it will be in force until being removed)?

N/A

4. Indicate the national legal sources about this judicial restriction

Proceeds of Crime Act 2002

5. Please, give us an idea about the characteristics of the registration of this restriction in your system

In terms of the Proceeds of Crime Act 2002, there are a number of recourses available to enable the recovery of property, the purchase of which was funded by the proceeds of crime. These typically involve registration in the Register of Inhibitions rather than the Land register with the inhibitory effect explained in answer 1(e). A trustee may obtain a recovery order under the 2002 Act which in turn would allow them to complete title which could permit an update to the land register.
