Specifics of the registration of apartments or premises that form part or a building
1. With respect to the registration of the apartments of the condominium: are there any specific formal characteristics of the registration related to the condominium or any characteristics that indicate that such apartments are subjected to a condominium, such as a formal statement, a number or other sign in the condominium or the corresponding share related to each apartment?
In the building (land) book there is a list of total number of separate ownership of premises (apartments) with the corresponding share related to each apartment. It means that each premises (apartment) has its own land book with a specific number.
2. Anyway, does registration of the apartment include the share of the apartment related to the global condominium?
Yes, it does. Registration of the separate ownership of premises (apartment) include the share of the premises (apartment) related to the global condominium. In Ist division of the land book we have to establish (it is mandatory) the number of common share which related to the global condominium.
3. What type of relationship is there between the registration of the building and the registrations of the apartments? Are the building and the apartments in absolutely separated registrations, with no connection at all?
The building registration is connected with the premises (apartments) registrations. First of all we have to register the building and then we can disconnect an apartment with a share related to each apartment. It is in one registration, because always when we would like to disconnect an apartment, we have to enter building’s book (land registry book) and write there the individual number of the apartment’s book. Each apartment has its own land book with individual number.
4. Which physical data of the apartments are usually collected in the registration to describe the property? (Floor or storey where located, surface, boundaries, access, rooms, postal address, cadastral code).
There are follows data of the separate ownership of premises (apartments) collected in the registration to describe the property:
- the address of the building
- the number of the apartment
- number of rooms, bathrooms, kitchen
- floor where located
- number of building book (where is registered the building)
- surface.
5. If registrations in your system refer to a plan or to the cadastral map, how (if at all) does the plan show the position (horizontal and vertical) of the apartment within the building?
Registration in our system doesn’t refer to a plan or to the cadastral map. The plan and the cadastral map from the local authority are almost always attached to the notarial deed. However we need excerpt from premises register to description an apartment in the land book. The plan is of horizontal position
