Registration
1. Sort of registrations or records. Please, describe your LR system criteria regarding the type of registration applied.
Registration is organised differently depending on the type of the Land Registry:
- In LR operating the system of transcription, registration is person based. The LR collects copies of documents and registration is sheet based on the following taxonomy: Owner, Mortgages, Seizures, Claims. For every person there is a special sheet where all deeds are registered containing full description of the property. Any kind of act presented in the LR must contain a detailed description of the property.
- In LR operating the cadastral system, registration is plot based. The LR collects copies of documents and registration is sheet based on the following taxonomy: Property, Ownership, Mortgages, Seizures, Claims. Each plot is identified by a unique cadastral number and for every property there is a special sheet where all deeds are registered containing a graphic sketch of the plot and the above mentioned elements describing its legal situation.
2. Deadlines for registration. Must land registrars or LR offices make the registrations or entries requested within deadlines? Please, if applicable indicate which are.
The deadline for the land registrar’ s scrutiny and registration varies from 24 hours to 5 days. These deadlines are mandatory.
3. Registration fees. Please, describe the main features of payment of LR fees. If you find it useful, suggest an example of registration fees of a sale of a property valued in € 100.000 and if it’s possible a mortgage.
LR fees are provided mainly by law 325/1976 as it has been modified and is currently in force. The law distinguishes between two basic categories of fees depending on the nature of the act; fixed fees for every act registered (9 € per registration), plus proportional fees for acts that have an economic value corresponding to the value of the transaction.
An exemple would be the following:
- for a sale of property of 100.000 € registration fees are 9 € plus 4,75 ‰ on the value, so a total of 484€
- for a mortgage of 100.000 € registration fees are 9 € plus 7,75 ‰ on the value, so a total of 784€
