Presentation of applications

According to the Code of Civil Procedure registration applications must be submitted according to the location of the registered immovable. There are four Land Registry departments in Estonia.

Registration applications must be digitally signed or notarized. Registration applications can be submitted through internet portal. Notaries use e-Notary, others Immovable Portal (https://kinnistuportaal.rik.ee/KAEP/login.aspx). If the portal is out of order, one can use e-mail or post or bring application to the Land Registry in person.

3. Does the fact of the presentation of the document (or application for registration) lead any type or entry or annotation in the LR Office books?

Upon registration of a registration application, a reference to the title of the register part is made (seal). The seal consists of the consecutive number of the land registry journal and the year.

4. In case of presentation based on temporary or provisional entries, please point specifically deadlines of them and also main features.

Registration application must be reviewed not later than within one month as of the date of receipt. The seal is visible upon accessing the Land Registry and on the Land Registry printout. The seal is deleted either after the making of a registration entry or after a negative ruling on entry has entered into force.

5. Is the payment of taxes a necessary condition or prerequisite for making the registration?

Before making the entry payment of a state fee must be done unless otherwise provided by law (e.g. correction of entry).

6. Is it possible to digitally submit documents to the land registry? Are there any restrictions with regard to the type of document that can be digitally submitted or is digital submission possible for all types of documents?

The Digital Land Register offers a quick and convenient opportunity for compiling and filing registration petitions, paying the state fee for petitioning an entry concerning a registered immovable, and for following the processing of the petition in real time. Persons can also use the Digital Land Register to give consent for making an entry into the land registry or provide authorizations for making a registration petitions. It is also possible to use the Digital Land Register for compiling and filing an appeal against rulings.

The Digital Land Register is a web-based information system meant to anyone who needs to file registration petitions for whichever reason and does not have to add a notarially verified disposition to the registration petition. In the latter case, the registration petition will be compiled and filed to the land registration department by the notary. The opportunity to file a registration petition through a notary will remain an option for all the other cases even after the launching of the Digital Land Register.

• Which form of submission is used more frequently – digital or non-digital? If possible, could you please provide an indication in percentages?
  75–80% of the registration applications are sent electronically by a notary (e-Notary) , 20–25% through the Immovables portal, and approximately 1% are on non-digital.

7. Are there any restrictions to the digital submission of documents? For example, is it necessary that the person offering the document for registration has a validated digital signature?

A petition, consent, authorization or ruling filed through the Digital Land Register is signed digitally. The documents added to the petition, consent, authorization and ruling are also digitally signed by the sender, unless they have already been digitally signed before.

8. Is it still possible to submit paper documents to the land registry?

If the documents added to the registration petition, consent, authorization or appeal cannot be filed through the Digital Land Register (mainly due to technical problems or in case of foreigners) the documents can be presented to the Land Register on paper.

After the Digital Land Register has gone online, the registration petitions can no longer be filed via e-mail. A registration petition sent via e-mail will be returned

9. Is it cheaper/more expensive to offer paper documents to the land registry? Could you provide a price indication for the registration of a deed of transfer (both digital and on paper)?
