1. What are the main rights in rem arising from successions in your system?

There are mainly two kind of rights in rem arising from succession in Luxembourg:

• property rights and
• “usufruit” rights.

2. What would the role of your Land Register or registrars be in order to put in practice the principle of adaptation? What contributions could the Land Register make?

In Luxembourg, the role of the Land registrars will be very limited in the framework of the adaptation of foreign rights in rem. They will not take a decision to adapt such a right, but they will only proceed to their registration (“transcription”) in order to guarantee their existence erga omnes.
