How to get the Information

1. WHO CAN APPLY FOR INFORMATION: ¿IS THE LR ABSOLUTELY PUBLIC OR NOT?

The land registers in the Republic of Croatia are public registers and anyone is entitled to access them either directly at the land registration court or over the internet. In order to obtain the information from the land registers, it is not necessary to have a legitimate interest. The person requesting the data from the land registers must know either the cadastral parcel number or the number of the land registry file but the data is not available if searched by the owner’s name. The information from the land register by owner’s name can be obtained by the corresponding State entities (tax authorities, public attorney’s office, police etc.).

2. WHERE CAN BE FOUND THIS INFORMATION:

Apart from the land registration court, the data from the land registers can be obtained on the internet but the extract obtained over the internet is only for informative purposes whereas the land registry extract obtained at the land registration court has the power of a public deed.

3. HOW TO OBTAIN IT:

The information from the land registers can be obtained if the cadastral parcel number or land registry file number is known. There is no separate form for searching the data in the land registers.

It is possible to request the data from the land registers in writing. In such a case, the court shall send the extract to the party by mail and the deadline for sending the extract depends on the workload of that particular court (from a couple of days to a month).

In any case, the request addressed to the court must be in Croatian and, if submitted in another language, must contain a certified translation into Croatian.

The cost of issuing a land registry extract is HRK 20 which amounts to approximately EUR 3.

4. WHEN DOES THE EXCERPT ISSUES?

If there is an unsolved application regarding a particular real property, then the extract clearly signals in the form of the so-called active flag that there is an unresolved application.

5. WHAT IS THE VALIDITY PERIOD OF THE EXCERPT FROM THE LAND BOOK?

No validity, it reflects the legal status by the moment of issuing

However, in everyday life, a new extract is always required during the sale, loan application, permit issuance because the most recent extract always reflects a more up-to-date status.

6. WHERE CAN THE EXCERPTS FROM THE LAND BOOK ARE USED?

  • Public institutions (municipalities, utility providers, finance)
  • Real estate transactions (notaries, lawyers)
  • Banking institutions
  • Private relationships

7. HOW TO IDENTIFY THE IMMOVABLES?

Cadastral identifier that provides uniqueness in the country/administrative territory

However, in practice, there are numerous situations where the data has changed in the cadastre without entailing the change of data in the land registers. In such cases, it is necessary to perform the identification of the land registration real property and the cadastral real property

8. LR AND CADASTRAL RELATIONSHIP:

The intention is to achieve in the future a real property registration and cadastre joint information system in order to avoid the situation in which the data in the land registers and in the cadastre mismatch. This new system is called the Real Property Registration and Cadastre Joint Information System. The system introduction has just started so it is difficult to say whether the system is successful or not.
